Petrol Works USA – Terms of Service & Liability Agreement

By purchasing, installing, or using any product from Petrol Works USA, the Customer (“you”) acknowledges and agrees to ALL terms below. You must accept these terms before completing checkout.

1. High-Performance Use – Assumption of Risk

Petrol Works USA designs and manufactures billet high-performance automotive components intended for modified vehicles, track use, and elevated horsepower environments. These products operate under conditions that inherently increase the risk of:

Engine, drivetrain, or transmission failure
Vehicle damage
Mechanical malfunction
Personal injury or property loss

By purchasing, installing, or using any Petrol Works USA product, you voluntarily assume all risks, known and unknown, associated with high-performance driving and aftermarket modification.

2. No Guarantee of Problem Prevention

Petrol Works USA parts are engineered to reinforce and improve OEM systems, but:

They are not a guaranteed or 100% solution.
No aftermarket part can eliminate all risk of failure.
Petrol Works USA cannot guarantee performance results, longevity, or safety of the vehicle.

These products may not prevent failures, especially on vehicles operating beyond stock power levels.

3. Limited Warranty – Verified Defects Only

Petrol Works USA provides a limited parts-only warranty that covers verified manufacturing defects ONLY.

Warranty Covers:

✔ Structural, material, or machining defects
✔ Failures proven through clear evidence (photos, videos, inspection)
✔ Items returned for examination if requested

Warranty Does NOT Cover:

✘ Engine, drivetrain, differential, turbo, or transmission damage
✘ Failures caused by tuning, improper installation, or misuse
✘ Oil starvation, overheating, detonation, boost spikes, or racing incidents
✘ Over-horsepower, excessive load, or high-heat applications
✘ Damage caused by other aftermarket parts
✘ Wear and tear, cosmetic blemishes, or user modification

No labor, shop time, towing, fluids, gaskets, tuning costs, rental vehicles, or incidental expenses are covered.
Warranty is parts replacement only, at Petrol Works USA’s sole discretion.

Petrol Works USA may void warranty claims that lack sufficient evidence.

4. Product Use and Customer Responsibility

Customer is solely responsible for:

Installation by a qualified professional
Ensuring correct torque, alignment, fitment, and compatibility
Maintenance and periodic inspection
Ensuring tuning and supporting modifications are correct for the part

Petrol Works USA is not liable for damage resulting from:

Improper installation
Incorrect torqueing
Non-professional installation
Poor tuning
Pre-existing mechanical issues
Failure to maintain the vehicle
Misuse, abuse, or racing accidents

5. Emissions, Smog, and Compliance Disclaimer

Most aftermarket parts, including high-performance billet products, may not comply with:

CARB (California Air Resources Board) regulations
EPA emissions regulations
State or local emissions laws

Customer agrees and acknowledges:

All emissions, inspection, registration, and smog compliance responsibilities rest solely with the customer.
Petrol Works USA is not liable for fines, citations, test failures, or registration issues.
Unless specifically designated as emissions-compliant or CARB-exempt, products are sold for off-road, race, or competition use only.

6. Limitation of Liability

To the fullest extent permitted by law:

Petrol Works USA, its owners, employees, and affiliates shall not be liable for ANY damages, including but not limited to:

Engine, turbo, or drivetrain failure
Transmission or differential damage
Loss of use, downtime, or rental expenses
Property damage or vehicle damage
Labor or installation costs
Tuning-related failures
Overheating, detonation, or misfires
Lost profits or diminished resale value
Personal injury or death

USE OF ALL PETROL WORKS USA PRODUCTS IS AT YOUR OWN RISK.

7. Indemnification Clause

Customer agrees to fully indemnify, defend, and hold harmless Petrol Works USA and its owners, employees, and affiliates from any claims, lawsuits, damages, fees, or liabilities arising out of:

Product installation
Product use
Vehicle operation
Emissions compliance issues
Accidents or injuries
Third-party claims

This includes attorney fees, court costs, and settlement costs.

8. No Implied Warranties

Petrol Works USA expressly disclaims all implied warranties, including but not limited to:

Implied warranty of merchantability
Implied warranty of fitness for a particular purpose

No representative, dealer, or reseller may alter or extend these terms.

9. Governing Law

These Terms shall be governed exclusively by the laws of the State of California.
Any disputes must be resolved in the state or federal courts of Orange County, California.

Customer agrees to jurisdiction and venue in Orange County courts.
